These Terms & Conditions apply to your booking and participation in the sheWellness Bali Retreat (“Retreat”) operated by Ellbrones Pty Ltd trading as sheWellness (“sheWellness”, “we”, “us” or “our”).
By making a booking or payment for the Retreat, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
1. The Retreat
The Retreat is a wellness retreat designed to provide participants with an opportunity to rest, reconnect and develop practical tools to support wellbeing and nervous-system regulation.
The Retreat includes a combination of wellness education, meditation, breathwork, gentle movement/yoga, reflective practices, workshops and other activities as described in the Retreat program.
The Retreat is not a medical, psychological or therapeutic treatment program and does not replace medical, psychological or other professional healthcare.
2. Retreat Details
The Retreat is scheduled to take place in Sanur, Bali, Indonesia, at the accommodation specified at the time of booking.
The Retreat program, activities, facilitators and schedule may be adjusted where reasonably necessary due to circumstances including weather, venue requirements, local conditions, availability of facilitators or other circumstances beyond our reasonable control.
We will endeavour to ensure that any changes do not materially reduce the overall quality or purpose of the Retreat.
3. Booking and Place Confirmation
Your place at the Retreat is confirmed once:

your booking has been accepted by sheWellness; and
-
the required initial payment or instalment has been successfully processed.
The Retreat is limited to a maximum of 10 participants, plus facilitator(s)
Places are offered subject to availability and are allocated on a first-come, first-served basis.
A booking is personal to the participant named at the time of booking and cannot be transferred to another person without our prior written approval.
4. Payment and Instalments
Where an instalment payment option is selected, you agree to pay all instalments by their scheduled due dates.
An instalment arrangement is a payment plan for the full Retreat price and is not a series of separate purchases.
Your obligation to pay the full agreed Retreat price remains even if you subsequently decide not to attend, subject to the cancellation terms set out below.
If an instalment payment fails, we may contact you to arrange payment. If payment remains outstanding, we reserve the right to suspend or cancel your booking, subject to any rights you may have under applicable Australian Consumer Law.
5. Cancellation by You
We understand that circumstances can change. Our cancellation policy is:
More than 90 days before the Retreat
You may cancel your booking and receive a refund of amounts paid, subject to any non-refundable third-party costs that have been expressly disclosed to you at the time of booking.
89–31 days before the Retreat
Cancellation will incur a fee of 50% of the total Retreat price.
Any remaining balance paid above the cancellation fee will be refunded.
Within 30 days of the Retreat
Cancellation will incur a fee of 100% of the total Retreat price.
No refund will ordinarily be provided for cancellations within 30 days of the Retreat.
Where an instalment plan is in place, any outstanding balance may remain payable in accordance with the cancellation terms.
All cancellation requests must be made in writing.
6. Exceptional Circumstances
We may, at our discretion, consider requests arising from exceptional circumstances, including serious illness, injury or bereavement.
Any alternative arrangement, credit, transfer or refund offered in these circumstances will be considered on a case-by-case basis and does not establish an ongoing obligation for sheWellness to provide the same arrangement in future circumstances.
Participants are strongly encouraged to obtain appropriate travel insurance that covers cancellation, medical expenses and other unforeseen circumstances.
7. Cancellation or Changes by sheWellness
We reserve the right to cancel, postpone or materially alter the Retreat where reasonably necessary, including because of circumstances beyond our reasonable control.
If we cancel the Retreat and are unable to provide a suitable alternative date or arrangement, we will provide a refund of amounts paid for the Retreat, subject to any rights you may have under applicable law.
Our liability in relation to cancellation or alteration of the Retreat is subject to applicable Australian Consumer Law.
We are not responsible for costs you incur independently of the Retreat, including flights, accommodation booked outside the Retreat package, visas, travel insurance or other travel arrangements.
8. Travel and Flights
Unless expressly stated otherwise in your booking, flights and international travel are not included in the Retreat price.
Participants are responsible for arranging and paying for their own:

Flights;

Airport transfers where not included;
-
Travel insurance;
-
Passport and visa requirements;
-
Vaccinations or other travel-related health requirements;
-
Personal expenses; and
-
Any additional accommodation or travel arrangements outside the Retreat.
We recommend that you do not make non-refundable travel arrangements until you have confirmed your Retreat booking and obtained appropriate travel insurance.
9. Visa and Entry Requirements
Participants are responsible for ensuring that they have the correct passport, visa and immigration permissions required to enter and remain in Indonesia.
Visa and immigration requirements can change. You should obtain current information from the Indonesian authorities and/or the relevant Indonesian embassy or consulate before travelling.
sheWellness does not provide immigration or legal advice and cannot guarantee that a particular visa will be granted.
10. Accommodation
Where accommodation is included in the Retreat package, accommodation will be provided at the Retreat venue or another venue of a comparable standard where circumstances reasonably require a change.
Accommodation arrangements, including room type and occupancy, will be as specified in your booking.
Any additional room upgrades, nights or services not included in your package are the participant's responsibility.
11. Wellness Activities and Personal Responsibility
The Retreat may include activities such as:

Meditation;

Breathwork;
-
Gentle yoga or movement;
-
Relaxation practices;
-
Mindfulness;
-
Emotional wellbeing practices;
-
Workshops and educational sessions; and
-
Other wellness activities.
You participate in all Retreat activities voluntarily and at your own discretion.
You are responsible for informing us before the Retreat of any relevant physical limitations, injuries, allergies, pregnancy, medications or other circumstances that may reasonably affect your participation.
You should seek appropriate medical advice before participating if you have any concerns about whether an activity is suitable for you.
You may decline or modify any activity at any time.
12. No Medical or Psychological Advice
The information and practices provided during the Retreat are for general education and wellbeing purposes.
They are not intended to diagnose, treat, cure or prevent any physical or psychological condition.
Nothing provided during the Retreat should be regarded as a substitute for advice from your doctor, psychologist, psychiatrist or other appropriately qualified healthcare professional.
If you are currently receiving medical or psychological treatment, you should consult your treating professional regarding whether participation is appropriate.
13. Breathwork and Movement
Certain practices, including breathwork and physical movement, may not be suitable for everyone.
Participants must follow instructions provided by facilitators and should stop an activity if they experience discomfort, distress, dizziness, pain or other concerning symptoms.
You acknowledge that you participate in physical and wellness activities voluntarily and accept responsibility for making appropriate decisions about your own participation.
14. Travel Insurance
Travel insurance is strongly recommended and should provide appropriate cover for:

Medical treatment and evacuation;

Trip cancellation;
-
Travel interruption;
-
Lost or damaged luggage;
-
Personal belongings; and
-
Other relevant travel risks.
You are responsible for determining the level and type of insurance appropriate to your circumstances.
15. Personal Belongings
Participants are responsible for their personal belongings throughout the Retreat.
sheWellness is not responsible for loss, theft or damage to personal belongings except to the extent required by law.
16. Participant Conduct
We want the Retreat to be a safe, respectful and supportive environment for everyone.
Participants agree to behave respectfully towards other participants, facilitators, venue staff and members of the local community.
We reserve the right to ask a participant to leave the Retreat where their behaviour is seriously disruptive, threatening, abusive or otherwise compromises the safety or wellbeing of others.
In circumstances involving serious misconduct, no refund will ordinarily be provided, subject to applicable law.
17. Alcohol and Other Substances
Participants are expected to act responsibly and respectfully in relation to alcohol and any other substances.
Participation in Retreat activities while impaired by alcohol or other substances may not be permitted where this creates a safety concern.
Illegal drugs are not permitted.
18. Photography and Content
From time to time, photographs or video may be taken during the Retreat for promotional or educational purposes.
We will seek appropriate consent before using identifiable images of participants for promotional purposes.
You may advise us if you do not wish to appear in promotional photographs or video.
19. Privacy
Personal information provided to sheWellness will be handled in accordance with our Privacy Policy and applicable privacy legislation.
Information may be collected where reasonably necessary to administer your booking, communicate with you, arrange the Retreat and respond to relevant health, dietary or accessibility information you voluntarily provide.
20. Changes to the Program
The published Retreat program is intended as a guide.
We reserve the right to make reasonable changes to activities, facilitators, timings, venues or other elements where necessary.
Where possible, we will provide participants with advance notice of material changes.
21. Force Majeure
We will not be responsible for failure or delay in providing the Retreat where this results from circumstances outside our reasonable control, including natural disasters, extreme weather, government restrictions, pandemics, civil unrest, war, terrorism, transport disruption, venue closure or other circumstances that make the Retreat unsafe or impracticable.
Where such circumstances arise, we will consider reasonable alternatives, including postponement or rescheduling, where practicable.
22. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
Where a provision of these Terms & Conditions is inconsistent with a mandatory legal right, that legal right will prevail.
23. Limitation of Liability
To the maximum extent permitted by law, you acknowledge that participation in travel, wellness activities and Retreat activities involves inherent risks.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded.
To the extent permitted by law, sheWellness is not responsible for loss or damage arising from circumstances outside our reasonable control or from services provided independently by third parties, including airlines, accommodation providers, transport providers or other external suppliers.
24. Third-Party Services
The Retreat may involve services provided by third parties, including accommodation providers, transport operators, wellness practitioners or other suppliers.
While we endeavour to work with reputable providers, third-party services are subject to the terms and conditions of those providers.
We are not responsible for circumstances arising from the acts or omissions of third-party providers except to the extent required by law.
25. Acceptance of These Terms
By making a booking or payment for the Retreat, you confirm that:

You have read and understood these Terms & Conditions;

You agree to be bound by them;

You have had the opportunity to ask questions before booking;

The information you have provided to us is accurate to the best of your knowledge; and
-
You understand that participation in the Retreat is voluntary.
